For decades non-competes have been issued by employers to employees as a means of preventing an employee from going to a competitor within the same industry. The purpose of the non-compete was to prevent trade secrets or proprietary information from being given to a competitor when an employee decided to leave. The issue is those non-competes are being applied to many workers who do not have access to trade secrets but are still being subjected to the same requirements as an employee that has that level of access. In many instances the non-competes act as a form of wage suppression which limits opportunities and adversely affects lower waged workers. In recent years, the legality and validity of non-competes are being challenged nationwide. Host Trey Evans discusses non-competes and the wind of change that is blowing them out of existence.
