G 1/25: The end of the description dispute?
Description
21 October 2026 | In today's episode, Christoph Schober and Thomas Burchardi discuss the Enlarged Board of Appeal's decision G 1/25 on the adaptation of patent descriptions to amended claims. Building on our earlier episode about the referral, they explore what the decision means for European patent practice, how it relates to G 1/24 and the interpretation of claims, and when inconsistencies between claims and descriptions actually require amendment. They also examine the practical implications for examination, opposition and appeal proceedings, and consider whether G 1/25 has finally settled the description dispute – or raised new questions, particularly in light of the pending referral G 1/26.
