Cornell Student Says 7 Frat Brothers Gang Raped Her, DA Called It "Consensual," Never Talked To Her.

Description

A Cornell student says seven fraternity brothers drugged her and raped her for hours, and Tompkins County District Attorney Matthew Van Houten read her report and decided it was consensual. She’s now suing Cornell, the fraternity and all seven men, and you’ve probably never heard a word about it.

Here’s what her lawsuit says. In October 2024, she went to the Chi Phi house to see a friend. He and another brother pressured her into taking ketamine. Two men became three, and three became seven. At 1:42 in the morning, one of them allegedly invited the rest of the house upstairs in the fraternity group chat, and the lawsuit includes the screenshot. When more men walked in, she tried to hide under the covers. It went on until almost six a.m.

She reported it to campus police a few weeks later. Van Houten’s office reviewed her statement and decided no crime happened. According to her lawyer, nobody from his office ever interviewed her. Not a prosecutor, not anyone trained to talk to survivors. They closed a gang rape case with less effort than a parking ticket. What was the investigation, vibes?

Now that people are noticing, Van Houten’s defense is her own statement, which he says described it as “voluntary, conscious, and consensual.” His proof? She told police she was “pretty ok” with a threesome at the start. My dude, a threesome is three people. You lost count somewhere around guy number four and just kept going. Saying yes to one guy is not a signed permission slip for his entire fraternity.

Then he quoted this, like it helps him: “each time Jane Doe asked to stop the sexual conduct, the sexual conduct stopped.” Each time. He’s defending himself with a sentence that proves she had to keep asking. Are you fecking kidding me. He also says his team never saw the text messages when they reviewed the case. Seven frat brothers, and nobody checked a phone?

So what did Cornell do to these guys? Her lawyer says two of the seven were expelled, and the rest got suspensions, workshops or essays. Essays. Cornell’s big comeback Monday: essays weren’t the only punishment. This is a school that suspended a student for protesting, which put his student visa on the line. Congresswoman Alexandria Ocasio-Cortez, at a town hall in Ithaca on Sunday: “We have an institution that issues a suspension on track for deportation … but we make rapists write an essay in private.” Five hundred words, double spaced, please cite the group chat.

Why should a case in Ithaca matter to you? Out of every 1,000 sexual assaults in this country, 975 perpetrators walk free, according to RAINN, and female college students report it about one time in five. This is why. You do the brave thing, and the man with the power to charge reads “stop” and hears “yes.”

When I was in college, it was her word against theirs. Now they put it in writing, and he ignored her anyway.

Van Houten reopened the case Monday and says he’ll take it to a grand jury. All it took was a lawsuit and a congresswoman to get a prosecutor to finally talk to her.
