As we await the verdict in the Lindsay Clancy case, I have a question: Should Lindsay be sent to prison, or should she be committed to a psychiatric facility for what she did to her three children?
If you believe Lindsay should go to prison, that could mean 10, 15, 20 years, or potentially the rest of her life behind bars.
But I think there is something a lot of people are missing in this conversation. If Lindsay is found not criminally responsible because of her mental state, including the defense’s argument involving postpartum psychosis, that does NOT necessarily mean she simply walks free. She 100% will be committed to a psychiatric facility for further evaluation and treatment, and that confinement could potentially last for many years depending on the legal process and her condition.
An insider told me we should expect the jury’s verdict as early as Monday or Tuesday. Until then, we’re discussing three major parts of this case.
First, we’ll talk about Dr. Phillip Resnick, a leading forensic psychiatrist and expert on postpartum psychiatric disorders, psychosis, and defendants who report hearing voices. He testified about Lindsay’s mental state and why he believes she was suffering from psychosis and should not be held criminally responsible.
We’re also discussing the makeup of the jury, which consists of nine women and three men, and whether that could play any role in how the evidence and the postpartum psychosis defense are evaluated.
Finally, we’re breaking down the closing arguments. I thought both sides did an amazing job presenting their cases, but from a mental health perspective, I believe the prosecution made some significant missteps that could matter when these jurors deliberate.
