Description
Alberta Judge to Rule on Teachers Strike Law: A Charter Rights Showdown
An Alberta judge is set to decide on Friday whether to halt the provinces back-to-work law for teachers. The Alberta Teachers Association seeks an injunction against Bill 2, which imposed a new contract and ended their strike last October. The decision follows a two-day court hearing in Edmonton last week.
Teachers lawyers argue the bill infringes on charter rights and that the governments use of the notwithstanding clause is invalid. Provincial lawyers counter that theres no basis for a pause and it could negatively impact students if teachers strike again.
If successful, teachers could legally strike but have pledged to wait three weeks for a fair deal, suspending the law until a full hearing in late September. Bill 2 was passed in just two days last October, ending a three-week strike and imposing a four-year contract teachers had rejected.
If denied, the law remains in effect, and the main case proceeds to court this fall. The ruling is scheduled for 10 a.m. on Friday.
