Daviss defense team had argued that the police used bad faith to obtain the nighttime warrant, citing old drug convictions and a gun arrest from years ago. However, the judge ruled that the dark helped police safely surround the house and evacuate neighbors if needed. This ruling is a major setback for the defense, as Daviss own words in recordings and his book are now likely to be used at trial. Davis remains in jail without bail, awaiting his murder trial set for August 10, 2026.
