The bill that ended the government shutdown threatens the U.S. hemp industry's future by including a provision that effectively bans most existing hemp-derived consumable products, including those containing CBD, Delta-8, and other cannabinoids. The legislation redefines hemp to be more restrictive, requiring that the total THC concentration (including Delta-8, Delta-10, and THCA) be no more than 0.3% on a dry weight basis. Previously, the 2018 Farm Bill only measured Delta-9 THC concentration, creating a loophole that allowed for the development of popular psychoactive hemp products.
