    Slam the Gavel welcomes back book author, Michael Sayen to the show. He was last on, on January 19th, 2022, Season 3, Episode #9.
     Michael explains contracts and covenants. The truth is, our culture is not compatible with proper family law.
     The most important thing is to look at marriage and divorce biblically and covenantally. I strive for laws that are biblically accurate. 50/50 shared custody is not a biblical approach to family law. It’s a band-aid approach to our current system. It just says, women can’t have their cake and eat it, too. They can’t expect there to be “no-fault” divorce and not apply the fair and  good faith principles of contract law.
     They want to apply “equity” to “no-fault divorce,” however, these laws cannot legally be looked at it that way because, marriage is a contract here in America (marriage license). Contracts are protected by the constitution from government interference. No state shall pass any Law impairing the obligation of contracts (Contract Clause - Article I, Section 10).
      Furthermore, not all civil divorce and remarriage situations are considered adultery in the Bible. However, the far majority of them are. Only those who have not been properly released from their vows (promise and obligations) by the proper nullifying the marriage contract.
      The woman is responsible for her acceptance of the covenant. “Who forsakes the companion of her youth, And forgets the covenant of her God” NKJV (Proverbs 2:17). You can’t have a biblically recognized divorce, but still have contractual obligations. It simply doesn’t work that way. Adultery means, the marriage covenant has not been nullified. It is still active in the eyes of God and will be used against you on judgement day.   
      Only the man was allowed to initiate the divorce. And it was only allowed to be voided if the wife committed adultery in the marriage. Or, some form of sexual immorality by defiling herself and breaking the one-flesh commitment.
