近日艺人蒋梦婕发布声明称遭偷拍勒索，从公开资料看此案定性应是敲诈勒索，但是在相关讨论中有人认为偷拍裙底只是违法不是犯罪，对此我认为不论从法律规定还是司法实践案例看，偷拍都有可能构成犯罪，谈谈我的看法供大家参考。
