校内碾亡小学生，肇事教师怎么判？出事前是否挥手或成关键

日前武汉一小学内发生学生遭碾压身亡事件，肇事教师被以过失致人死亡罪刑拘，虽然家属认为存在二次碾压并称是故意杀人，但当时教师称曾挥手驱赶或成为定案关键，参考相关案例我会认为量刑在三年以上，当然具体判决结果以司法机关为准，在此分享一点我的看法供参考。
