בשיעור היומי כותב הרמב"ם: "כל חשוד על השבועה אין משביעין אותו... ואפילו רצה התובע לא שומעין לו". טעם הפשוט לזה הוא דמכיון שאינו נאמן על השבועה אין תועלת בשבועה זו. אבל לפי"ז למה לא להשביע אותו על הספק? ובפרט אם התובע רוצה שישבע? וי"ל שעיקר הטעם הוא מפני האיסור ד"לפני עוור לא תתן מכשול" - שלא להכשיל אותו בשבועת שוא. ומזה יש ללמוד הוראה נפלאה: אפי' אם מדובר באיש ירוד ביותר, דאע"פ שיודע שממון חבירו נוגע לו בנפשו וכו', ומ"מ תאותו לממון חבירו גדלה כ"כ שהוא מוכן לישבע ע"ז לשקר, שהוא מהאיסורים הכי חמורים בתורה, ואעפ"כ דואגת התורה גם למצבו הרוחני של יהודי זה להצילו מחשש שבועת שקר! וזהו ענינה של תורה ש"מביאה רפואה לעולם" ועאכו"כ ל"חולי הנפש" מישראל, שבכאו"א מהם חקוקה התורה בעצם מציאותו, ו"ישראל" ר"ת "יש ששים רבוא אותיות לתורה". ובפרט פנימיות התורה ש"המאור שבה מחזירו למוטב" - שע"י חוזר האדם למקומו האמיתי שהוא הרצון לקיים רצונו ית'.

Synopsis

Today’s Rambam states: “Whenever it is suspected that a person might take a false oath, no oath is administered to him…Even if the plaintiff desires [that the defendant take this oath], we do not heed his request.” The simple reason is that because we suspect he will take a false oath, there’s no point administering one. But seemingly, since our suspicion is only a doubt, why not have him take the oath nonetheless, especially if the plaintiff wants him to take an oath? We can explain that the main reason is because of the prohibition, “Do not place a stumbling block before the blind” – to avoid causing him to stumble by taking a false oath. From this, we can learn a remarkable lesson: Even when it comes to a very lowly person, who knows how much the plaintiff needs his money, yet is still prepared to swear falsely that he doesn’t owe it – one of the most severe prohibitions in the Torah – still the Torah cares about this Jew’s spiritual state, to the point that it saves him from the risk of a false oath. The Torah “brings healing to the world,” and certainly to those Jews who are spiritually il. The Torah is engraved in every Jew’s very essence, and “Yisrael” is an acronym for “There are six hundred thousand letters in the Torah.” And especially the inner dimension of the Torah, for “the luminary with it returns him to good” – bringing a Jew back to his true place and the desire to fulfill Hashem’s will.
